At this time, the state applies a 10% tax rate to Adjusted Gross Revenue (AGR). There are currently two major sources of dispute regarding the definition of AGR:

  • Promotional deductions – Operators can deduct the cost of “free play” and promotional credits from taxable revenues; however, this amount is not to exceed 25% of total wagers.
  • Revenue impact – In early 2026, thousands of dollars were spent on promotions, leading to net losses reported by major operators for tax purposes, resulting in a much lower than anticipated tax yield to the education fund of the state.

Operators must use official data from the leagues for “Tier 2” wagers (in-game/live betting) while complying with the 21+ age limit and geofencing protocols.
