YouTube Profiting from Illegal Betting Ads in Brazil

As Brazil sharpens iGaming and wagering rules, a fresh worry has developed: YouTube, the biggest video platform worldwide, is reportedly benefiting from ads endorsing illegal online betting sites. Such advertisements keep showing up all over the platform despite legal limits and current government agreements, hence questioning digital supervision and consumer protection.

Illegal Wagers Live on YouTube

Brazilian legislation forbids unapproved betting operators from promoting themselves. These companies must pay R$30 million in fees, acquire a permission from the Ministry of Finance, follow certain regulations, and tax their earnings. Still, many betting sitesoperating without these legal standardsare often highlighted in the advertising space on YouTube.

An analysis discovered that unapproved betting sites appear in every third suggested YouTube video. Often luring users with fraudulent cash incentives at registration, these sites employ dubious domain names to avoid the government-sanctioned Bet.br domains. Usually, the registration procedure avoids full identity or age checking, therefore allowing minors to use gambling facilities.

How the Plan Operates

Usually, clicking on these advertisements takes consumers to virtual stores where they download a mobile app linking them to unlawful betting operations. Though they are gambling-related, some of these applications are listed as “free for all ages” in virtual marketplaces. These programs only need a phone number and a password to set up once installed, an ID, and no evidence of age.

Tracing these actions is not always simple. While seeking licenses from countries like Curaçao, companies sometimes register in places like Hong Kong. If one site goes down, another one with a somewhat different URL or business name swiftly substitutes it. Apps similar to those claimed to be created by “Ballet Lyn” have surfaced in Brazilian retailers, with users claiming fraud such as withdrawal problems or malware infections.

YouTube Under Review

Many of these websites have been classified unlawful by the Brazilian National Telecommunications Agency (Anatel). Google-owned YouTube says it is looking over flagged content and points out that it changed ad policies in September 2024. Still, the site hasn’t made public the amount of money made; it does keep accepting payments for these advertisements.

Attorney Luiz Felipe Maia advises that advertising illicit sites could lead to penalties between R$50,000 and R$2 billion. Enforcement, however, calls for official action from Brazil’s Secretariat of Prizes and Betting (SPA). Maia contends that while the Internet Civil Framework protects platforms somewhat, repeated violations might warrant punishments. “If the material is recurrent, YouTube should have stricter KYC rules for advertisers,” he remarked.

YouTube insists that all Google Ads rules and Brazilian laws apply to all advertisers. Ad removal and account freezing can result from violations. Still, officials like National Secretary Giovanni Rocco contend the platform benefits from unlawfulness. “YouTube streams live checks for unlawful content but continues to gain from illegal gambling commercials.” That’s contradictory, he remarked.

Government Action and Industry Reaction

The SPA has sharpened its campaign against illegal internet gambling content. Following several meetings, YouTube toughened its advertisement screening. Together with Conar (Brazil’s ad self-regulatory agency) and the Digital Council, SPA claims to have blocked over 11,000 illicit sites so far.

President of the ANJL (National Association of Legal Gaming), Plínio Lemos Jorge stressed the increasing danger of this “clandestine, extremely technological network.” He invited more federal police to tear down illegal buildings and safeguard users.

As Brazil builds a strong betting policy, the function of worldwide digital platforms like YouTube is still under investigation. Regulators and technology behemoths have to urgently discuss whether enforcement will follow evolving digital plans.
