Virginia Lawmakers Renew Push for Gaming Commission, Online Casino Bill

Virginia legislators have returned to the 2026 session with a proposal to overhaul gambling oversight.

House Bill 271, filed on January 9, would establish the Virginia Gaming Commission as an independent regulator, consolidating licensing, enforcement, compliance, and responsible gambling programs under one body.

The move would strip current responsibilities from the Lottery, Racing Commission, and Department of Agriculture, placing all legal gaming activities, casinos, sports betting, historical horse racing, and charitable gaming under a single authority.

The bill also outlines a governance structure led by a commissioner appointed by the Governor and supported by a new Gaming Commission Board. Dedicated divisions for audits, external affairs, and problem gambling are included, signaling a shift toward unified oversight.

The proposal arrives alongside separate legislation to legalize online casinos and poker.

2028 launch planned

The proposal sets a firm deadline, requiring regulations for the new framework to be in place by January 1, 2028. Alongside the timeline, lawmakers have built in tougher penalties to ensure compliance.

The draft expands both civil and criminal sanctions, spelling out fines of up to  $50,000 for individuals and as much as $200,000 for companies caught tampering with gaming equipment or software.

Running unauthorized mobile casino games inside venues could trigger felony charges, license suspensions, and fines that climb to $100,000, with equipment subject to seizure. Civil penalties would also reach unlicensed operators, calculated against the revenue earned from illegal play.

Violators to face heavy fines in proposed market

The draft legislation gives the new Commission wide powers to act against operators who break the rules.

Licences and service permits could be suspended, revoked, or denied renewal, while civil penalties would apply to misconduct ranging from fraud to misrepresentation. Offenses that undermine public confidence could draw fines of up to $10,000.

Advertising is also covered, and misusing state branding or other protected marks would carry penalties reaching $50,000. Money collected through fines and fees would not disappear into the general budget but instead flow into a dedicated fund to support the Commission’s work.

The bill calls for closer coordination through the Office of the Gaming Enforcement Coordinator within the Department of State Police, ensuring state, local, and federal authorities share information more effectively when tackling violations.

Another year, another iGaming push

Virginia lawmakers are back with a fresh attempt to reform gambling oversight, almost a year after a similar proposal stalled.

House Bill 2498, introduced last session, sought to establish a gaming commission but never made it past the House Appropriations Committee.

This year’s measure, HB 271, revives the idea, with supporters pointing to the steady expansion of gaming in Virginia, from casinos to sports betting, as reason enough to centralize oversight under a single body.

For now, the bill awaits committee assignment, setting the stage for another round of debate over how Virginia should manage its growing gambling market.
