Virginia Governor Vetoes Skill Games and Casino Legislation

Virginia Governor Abigail Spanberger officially vetoed two major gaming bills recently. She rejected Senate Bill 661 concerning skill games on Friday. Thursday saw the veto of Senate Bill 756. This second measure proposed a new Fairfax County commercial casino. The newly elected Democratic governor cited significant regulatory concerns. She took office less than three months ago. Spanberger strongly advocates for a centralized authority to oversee all gaming operations.

Regulatory Structure Drives Legislative Roadblocks

Virginia currently operates with a highly disorganized regulatory framework. Different state organizations oversee the lottery, sports betting, and casino gaming. Authorities also separately oversee live and historical horse racing markets. Spanberger argues that this existing system creates problematic gaps in industry oversight. She believes this fragmentation threatens consistent enforcement across the state. Furthermore, she stated it hinders the commonwealth’s ability to protect consumers effectively.

Introducing new gaming machines naturally strains these current enforcement capabilities. Therefore, the state requires a single unified gaming commission first. Expanding the digital or physical market demands this structural change immediately.

Skill Games Present Significant Market Potential

Senate Bill 661 outlined a huge statewide skill game expansion. The Virginia Lottery Board would approve up to 25,000 machines in the state. However, lottery officials currently lack exact figures regarding active machines. The state budget department estimates roughly 90,000 machines operate currently.

Skill games carry a complex legal history in the state. Regulators initially allowed these games temporarily during the recent pandemic. Lawmakers later instituted a strict ban on the slot-like machines. Manufacturers and host businesses quickly won a lower court injunction. This legal victory temporarily blocked the state from enforcing the ban. The state supreme court ultimately upheld the official ban in 2023.

The vetoed legislation proposed a 25 percent tax on gross profits. The state general fund would collect 75 percent of this tax. Local host municipalities would retain a 15 percent revenue share. Administrators would use the remainder for enforcement and problem gambling resources. The bill projected substantial annual tax revenues reaching $346.8 million. This specific financial figure requires each machine to generate $152 daily.

Geographic Data Influences Veto Decision

The governor also reviewed location data from the pandemic legalization period. She noted geographical clustering regarding previous machine placements across the commonwealth. State data highlighted specific demographic patterns within these host locations. The data showed frequent machine placements in communities demonstrating higher poverty rates. These areas also showed lower educational attainment metrics and diverse populations. As a result, the governor stated the state lacks proper impact mitigation tools. Former Governor Glenn Youngkin also rejected a similar expansion bill 2 years back.

Casino Expansion Requires Local Referendum Support

Planning of a projected casino resort at Tysons Corner was put on hold by the second veto. At the moment, Fairfax County is Northern Virginia’s most populated area. Across the Potomac River from Washington, there are more than 1.1 million people. Local county leaders actively opposed the new commercial casino development.

Furthermore, Senate Bill 756 explicitly bypassed a standard public voter referendum. Spanberger emphasized the General Assembly rarely dictates specific casino locations directly. She believes this approach eliminates essential local decision-making processes. It potentially forces casinos onto communities despite local governing board opposition.

Virginia successfully established multiple casino markets using the local referendum model. Facilities currently operate or possess approval in several key regional cities. These jurisdictions include Bristol, Danville, Norfolk, Petersburg, and Portsmouth. Petersburg voters recently approved their project after Richmond defeated two separate referendums.

The Legislative Path Forward for Gaming Bills

Lawmakers still possess a final opportunity to pass both gaming measures. The General Assembly reconvenes in Richmond on April 22. Legislators will directly review the governor’s vetoes during this upcoming session. Both legislative chambers require a strict two-thirds majority to override a veto.

Industry analysts keep a careful eye on these bills’ initial vote margins. Just last month, conference committees came to final deals on both proposals. The skill games bill was previously adopted by the House with a vote of 57-38. Then, by a vote of 23 to 15, the Senate approved Senate Bill 661. In the meantime, the House approved the Fairfax casino measure 55–41. A majority vote of 25 to 13 was then reached by the senators. A major legislative problem is getting the required two-thirds approval.
