Then came the Sky Bet Gary Neville ASA ruling, which has left gambling marketers across the UK questioning how far the rules now reach.

The Advertising Standards Authority (ASA) ordered Sky Bet to remove the post, saying the football pundit still holds strong appeal among under-18s. For operators, it is another reminder that advertising compliance in the UK is becoming harder to define.

ASA ruling deepens advertising confusion

The Sky Bet Gary Neville ASA ruling followed a promotional tweet featuring Neville on The Overlap, a YouTube series where he discusses Premier League predictions. The ASA judged that Neville’s social media presence and role as a pundit made him appealing to younger audiences.

This was unexpected. Past rulings had allowed retired footballers in ads if their audience was primarily adult. Even ASA guidance lists pundits as “moderate risk”. The latest interpretation has shifted that boundary once again, leaving marketers unsure where the line now stands.

That uncertainty is fast becoming the story.

Flutter challenges the consistency of ASA guidance

Flutter Entertainment, which owns Sky Bet, has criticised the decision.

The company said the guidance “defies both precedent and common sense”, arguing that The Overlap targets an adult audience.

Flutter also noted that no public complaints were made about the tweet. The ASA had lodged the complaint itself. The operator warned that licensed companies are being punished for compliance while illegal and offshore platforms advertise freely online.

The imbalance, it said, makes fair competition increasingly difficult.

Social media adds another layer of risk

The ASA’s main concern was Neville’s online following.

It found that more than 135,000 of his social media followers were registered as under-18s. New guidance from the Committee of Advertising Practice (CAP) now treats anyone with more than 100,000 under-18 followers as a high risk for gambling promotions.

Regulators say this ensures consistency. The industry argues that it makes digital marketing almost unworkable. Each time the rules tighten, operators must re-evaluate every partnership and post.

The next adjustment could come sooner than expected.

Wider impact on sports sponsorships

The ASA ruling has wider implications.

Kwiff and Betway were also penalised on the same day for similar breaches involving Lewis Hamilton and the Chelsea FC logo. Both cases show that even approved sponsorships can fall within the grey area of what counts as “strong appeal”.

If this pattern continues, gambling operators may need to rethink their relationships with sporting brands and public figures. What once seemed safe now feels uncertain.

The challenge for marketers is balancing visibility with responsibility, in a market where the rules keep changing.

Balancing regulation and competition

Meanwhile, unlicensed operators continue to reach UK audiences through affiliates and social platforms. They face none of the restrictions imposed on licensed brands. Flutter warned that this imbalance risks driving players towards less safe options.

For companies operating under UK law, compliance now feels like a moving target. The question is no longer whether they can follow the rules, but whether the UK’s advertising framework can survive the confusion it has created?
