Rio Branco Bans Betting Advertising at Public Events in New Municipal Law

Municipality of Rio Branco has approved a new limitation regarding betting advertisement at public events. According to the new law established by Municipal Law No. 2,678, betting advertisements are banned in municipal events and events organized by municipal institutions. The ban applies to all bets on sports and online casinos, as well as games with elements of pure chance.

Broad Scope of Advertising Restrictions

The prohibition concerns several types of advertisements, including graphic, audio, video, and digital ones. Any kind of advertising medium is not allowed to promote gambling in public places.

In addition, the new rule applies to online platforms and software products that advertise unauthorized gambling games in Brazil. Interestingly, this restriction is also applied to fixed odds betting, which is governed by federal legislation.

It means that the municipal administration has chosen an even more restrictive approach than federal regulators when controlling gambling in the region.

Impact on Contracts and Cultural Events

The law also includes the prohibition of betting advertisements in cultural events organized by the municipal administration. The administration cannot sign any contract with performers, bands, or actors who promote betting companies in their performances or have betting sponsorship.

Contracts must include special clauses to ban betting advertisements during the event. Moreover, organizers should guarantee full compliance with this restriction throughout the entire event.

Restrictions also concern the prohibition of betting advertisements in any visual element, such as clothing, stage setting, equipment, etc. It ensures that the organizer will not promote gambling in any visual or audio form.

Penalties and Enforcement Measures

Violation of this law results in sanctions imposed by the municipality. First of all, the administration can annul the signed contract with the violator. At the same time, a fine will be charged. Its amount reaches the total cost of the contract, depending on the degree of the violation.

Moreover, any individual or legal entity can inform the competent authority about a violation of the law. This provision increases the possibility of identifying violations and imposing fines.

Exception for Sports Competitions

Although there are severe restrictions, there is a particular exemption in this law. Gambling advertisements in the uniforms of professional and amateur sports clubs are allowed during competitions.

This exception allows betting companies to promote themselves in the sporting environment, but limits their appearance in municipal and sponsored events.

This law was ratified by Mayor Tião Bocalom and developed by Councilwoman Lucilene Vale. The law has been in effect since the day of approval. This case study shows how municipalities in Brazil impose restrictions on advertising gambling in their territory.
