A court in the Brazilian State of Pernambuco has dismissed all claims brought by Spribe in proceedings involving NSX, the company associated with the Betnacional brand.
The September 2026 ruling found no trademark infringement, copyright infringement or unfair competition practices by NSX, resulting in the rejection of Spribe’s claims.
Court Rejects Infringement Claims Against NSX
The Pernambuco judgment addressed allegations concerning the AVIATOR brand and related intellectual property rights.
According to the ruling, the court found that NSX had not infringed trademarks or copyright and had not engaged in unfair competition practices.
All of the claims brought against NSX in the proceedings were therefore rejected.
Decision Follows Earlier São Paulo Outcomes
The Pernambuco ruling comes after earlier favorable court outcomes for Aviator Studio in São Paulo.
Courts at both the first-instance and appellate levels previously rejected urgent measures sought by Spribe against Aviator Studio and its operations.
Those decisions allowed Aviator Studio to continue operating while the broader AVIATOR trademark dispute moves through the judicial process.
AVIATOR Disputes Continue in Brazil and Other Markets
The latest decision represents another development in a wider series of disputes surrounding the AVIATOR brand and associated intellectual property rights in Brazil and other international markets.
The Pernambuco ruling specifically addressed the substantive claims brought against NSX, including allegations of trademark infringement, copyright infringement and unfair competition.
The court rejected all three allegations.
