Regulatory Landscape

Overview of Gambling Regulations

Palau’s gambling laws are very limited and unregulated, with no fixed law that describes and outlines land-based gambling or internet gambling. The Constitution of Palau essentially prohibits casino gambling and many forms of offline gambling, indicating that gambling is mooted upon as unwelcome by most of society. Land-based casinos are specifically outlawed, and there has been little ability to successfully legalize traditional gambling venues. It does permit some limited exceptions, such as Virtual Pachinko and Internet Digits Lottery, that were incorporated by reference in the applicable laws of Palau, which were enacted in 2000 and amended in 2008. 

They established two licenses apiece for the virtual pachinko and internet digits lottery. Besides some limited exceptions, in both cases, the requirement for online games is that residents of Palau not gain access via the internet. Having dexterity as the purpose, in protecting our citizens from the risks of gambling, it is reasonable and prudent to acknowledge that only the first of online games could be appropriate to allow. 

Intrinsically, online gambling is unregulated. While no formal licensing system is vis a vis, nor a regulatory authority with respect to internet gaming, the citizens of Palau use foreign offshore casino games. It is legal for persons in Palau to play foreign-operating offshore casinos, but still unlicensed by any local authority. Additionally, players are never prosecuted, yet they are also not reasonably afforded any protection due to a regulatory blackhole.

Licensing Requirements and Regulatory Bodies

The main gambling regulatory authority in Palau is the Palau Casino Gaming Control Commission, established by the Casino Commission Act, which regulates companies’ licensing for land casinos (none of which are operating legally). In the case of online gaming, the Offshore Internet Gaming Commission was outlined in a 2022 legislative bill for the purpose of regulating and monitoring virtual gaming operators, while background checks, concession agreements, and compliance are part of the commission’s activities. 

It was intended that the commission would oversee issuing licenses to operators of online casinos, sports betting, lottery, and virtual pachinko, with the operator working under a concession agreement. 

Until now, a limited number of licenses have been issued for virtual pachinko and internet digits lottery, each for recognition of $45,000 annually. Licensed operators are requested to pay an annual fee and an annual tax of 4 percent of the operator’s net gaming revenue (equal to income less winnings paid out), but to date, the government has not collected any tax revenue from the licensed operators, due to the lack of operational activity. Licensed operators are required to have their headquarters in Palau and must comply with access restrictions, which are intended to restrict Palauan citizens from accessing the illegal operators’ sites and participating.

Details on Taxation and Compliance

Currently in Palau, the licensing regime for virtual pachinko and lottery includes a 4% tax on gross gaming revenues (less payouts) that licensees have to pay annually. Licensees must allow for audits and comply with anti-money laundering (AML) obligations and responsible gaming obligations, although the AML and responsible gaming regulations are still developing.

Uncensored gambling activity is illegal with penalties that vary from fines to imprisonment; it is important to note that enforcement is limited in the online space. No player protection measures are entirely legislated or enforced yet, as there is no full regulatory framework in place.

Upcoming Changes in Legislation

Recent legislative actions have focused on creating something more comprehensive, specifically an improved regulated framework with the proposed “Palau Tourism Enhancement Act,” or proposed “Controlled Gaming” or similar bills to legalize and regulate integrated resorts, casinos, and online gaming as a way to sustainably diversify Palau’s economy and increase revenues to the government while generating jobs. The proposed bills would implement a Gaming Commission to impose regulations on gaming with protection against gambling addictions and social harm.

Lastly, to add to the regulatory limbo of the gaming legislation, the public debate and public policy surrounding the balance of the economic benefits of legalized gaming with the societal concerns surrounding legalized gaming continues, and as such, Palau’s gaming regulatory landscape as of 2025 continues to be vulnerable to change, but does not have a conclusive path yet.
