Nevada Blocks Prediction Market Kalshi for Two Weeks Over License Dispute

A Nevada state judge temporarily stopped the prediction market Kalshi from operating inside the state. In detail, Judge Jason Woodbury signed a 14-day restraining order on Friday. Users can place bets on the results of actual events in prediction markets. Consequently, the corporation is prohibited from providing any betting contracts on sports, elections, or entertainment events by this court order. This halt was initially requested by the Nevada Gaming Control Board in order to shield local patrons from unauthorized gambling.

Courts Return Power to the State

Before the state judge acted, a federal appeals court made a major decision on Thursday. First, the federal court rejected an emergency request from Kalshi. The company wanted federal judges to block Nevada regulators immediately. Instead, the appeals court handed jurisdiction back to the local Nevada courts. Because of this ruling, the Nevada Gaming Control Board easily pushed forward with its local restraining order.

Licensing Problems Arise

Next, Judge Woodbury reviewed the local gambling laws. He quickly determined that Kalshi operates a traditional sports pool. However, Nevada law strictly requires a state gaming license to run a sports pool, and Kalshi currently holds no such license. Therefore, the head of the Gaming Control Board stated that the state must stop the company to protect the public.

Kalshi Fails to Prove Federal Control

During the legal fight, Kalshi presented a strong defense. The company argued that the United States Commodity Futures Trading Commission holds complete control over all event contracts. Thus, Kalshi believes state regulators possess no legal authority to intervene in their business.

The Judge Responds

Nevertheless, Judge Woodbury completely rejected this argument during the Friday hearing. He reviewed the existing legal authority and decided that the current laws do not support federal control right now. Moreover, he viewed the entire legal conflict as a complex and fast-moving situation. Ultimately, the judge noted that an unlicensed company stops the state gaming board from doing its official job. Now, the court plans to hold another hearing on April 3 to consider a longer ban. Meanwhile, Kalshi representatives refused to discuss the decision.

Other States Attack Prediction Markets

Furthermore, Nevada simply joins a growing list of states attacking Kalshi. Earlier this year, a Massachusetts judge banned the company from offering sports contracts. Eventually, a higher court lifted that specific ban after a lengthy appeal process.

Arizona Takes Harsh Action

Similarly, Arizona took much harsher action just this past Tuesday. Kalshi was officially charged with a crime by the Attorney General of Arizona. The firm is accused by state prosecutors of operating an illicit gambling ring. In response, the chief executive officer of Kalshi strongly criticized the charges and called the state action a massive overstep.

Federal Regulators Fight Back

At the same time, the federal government wants to keep control over these betting platforms. The chairman of the Commodity Futures Trading Commission frequently argues that federal authority always overrides state-level rules. Therefore, he promises to fight these aggressive state actions in court. Additionally, his federal agency actively develops new policies to govern all prediction markets across the country.

Sports Leagues Join the Market

Finally, major sports leagues also recognize this growing market. Major League Baseball just signed a formal agreement with the federal commission this week to monitor prediction markets. The baseball league also announced a brand new business partnership with a different prediction market called Polymarket. Despite all these moves, multiple courts across the country still struggle to decide whether state or federal governments hold the true legal power over these platforms.
