The Municipality of Necochea has appealed a judicial ruling that suspended the public auction of the Necochea Casino Complex, a historic landmark located in the coastal city of Buenos Aires Province in Argentina.
Originally, the auction was set for February 11, following a series of political and administrative debates within the local Necochea City Council. After a series of debates, the legislative body approved the auction of the landmark property by a majority vote, authorizing the local government to proceed with the public auction.
However, just before the auction was set to take place, the Administrative Litigation Court of Necochea issued a precautionary measure that suspended the auction.
Court Identifies Irregularities in Administrative Procedure
According to the judicial ruling, the court suspended the auction based on a series of issues that arose from the administrative process that authorized the auction of the landmark property.
Reports from local media outlets revealed that the court cited a series of irregularities in the administrative process that authorized the auction of the landmark property.
Some of the major issues cited by the court include the following:
The detection of irregularities in the administrative process prior to the authorization of the auction.
The failure to submit and incorporate key information requested by the court into the official case file.
The fact that the requested documentation, initially required in early December, had not been included before the ordinance authorizing the auction was approved.
The court’s assessment that the conditions required by current regulations to proceed with the auction had not been fully met.
Therefore, the court decided to temporarily stop the process to clarify the aforementioned issues.
Municipality Challenges the Precautionary Measure
In response to the court’s ruling, the Municipality of Necochea has decided to challenge the precautionary measure.
The municipality filed an appeal against the ruling to suspend the process, arguing that the ruling should be appealed to a superior court. As a result, the case will be forwarded to the Administrative Litigation Appeals Chamber of the Mar del Plata court.
This court will review the arguments of the executive branch of the municipality and the actions taken by the first-instance court, which previously decided to maintain the precautionary measure.
Appeals Court to Determine Next Steps
What the appeals court will have to determine is whether the suspension should be maintained or lifted to proceed with the public auction of the Necochea Casino Complex. Meanwhile, the sale of the property will remain suspended.
What the appeals court decides will determine the fate of one of the biggest real estate assets in the City of Necochea. The ruling will also set a precedent for the sale of similar assets in the region.
