Gambling Regulation in Guinea

Guinea is on the western side of Africa, bordering the Atlantic Ocean. It’s home to many natural resources which need to be used to their full potential. Guinea possesses large bauxite reserves, iron, gold, and diamond reserves. But still, the economy is heavily dependent on agriculture. The salaries are low, there’s a lack of trained personnel, and tax evasion is common.

Gambling does exist in Guinea, but it’s not as regulated as in other countries. National lottery and sports betting have the most regulation. The gambling industry as a whole is small and underdeveloped, with not all casinos and online gambling platforms being legal. The underdevelopment could be prescribed to Guinea being a predominantly Muslim country whose religious views prohibit gambling.

This article was written on September 23rd, 2024, and is based on information available at that time. Because regulations by nature are subject to change, one should consult with local experts for the most current information available pertaining to Guinea’s gambling laws.

Who oversees gambling in Guinea?

The Ministry of Finance is the leading body for overseeing gambling. They also issue licenses and monitor compliance. Guinea doesn’t have a dedicated regulatory authority for gambling, so there are many loopholes in the industry. Because of the lack of such a body, no one is overseeing the regulation, enforcement, and player protection as much as they should. The Ministry only takes care of some basic regulatory functions. Local oversight is also close to being nonexistent.

The Ministry has a job to check the legality of gambling establishments and their operators. They make sure they are licensed and obedient to laws. Licenses are handled by the Ministry, but the process of obtaining one is not as strict and detailed as for other more developed countries.

Licensing in Guinea

Lottery Licensing

A popular form of gambling in Guinea are national lotteries which are state-run and only a few operators get the chance to manage such activities. Lotteries in Guinea are said to raise funds for public and charitable causes.

Sports Betting Licensing

Apart from lotteries, people also enjoy sports betting, especially when it comes to football. The operators who are licensed can provide the people with betting shops or kiosks.

Gaming Machines and Casinos

These are not as popular in Guinea. There are almost no land-based casinos in the country, and no clear legal framework for these activities.

Operators must apply for a license, and the process includes submitting a plan of operations, proof of financial stability, and compliance with laws about taxation. Because Guinea lacks an independent gambling regulation body, the process of approval may not always be as transparent and formal as in other bigger industries.

Once the operators are licensed, they have to pay a licensing fee, and have to pay taxes based on their gross gambling revenues (GGR). The gambling revenue is directed toward state coffers or public causes.

Unfortunately, the gambling industry in Guinea faces serious problems. There’s no dedicated regulatory body, and the legal framework is more than underdeveloped. Due to only a few legal gambling activities, and no formal oversight, illegal gambling is at its all time high. Illegal activities can operate freely outside the perimeter of the licensing system.

When it comes to online gambling, there’s also no legal framework or licensing process. Consequently, people can access international online gambling platforms easily, and can enjoy no regulation and taxation.

Why is gambling underdeveloped?

Culture and Religion

Guinea is predominantly Muslim, and under Sharia Law, gambling is considered haram. There’s also a significant social stigma with gambling, Because gambling can cause negative outcomes and addictions, it’s not accepted as entertaining and guilt-free by all generations.

Economy

A large portion of the residents live in poverty. Guinea is one of the poorest countries in the world, and people just can’t afford to spend their hard-earned money on gambling. They would rather spend money on food and water.

All the developed gambling industries in bigger countries depend on the middle class, but in Guinea, the middle class is small.

Infrastructure

The infrastructure is of poor health. Electricity is unreliable, internet access is poor, and transportation is limited, all of which causes difficulties in trying to manage a gambling business in Guinea.

Political Instability

Coups, protests, and changes in leadership all happened in Guinea, which spurred the inconsistent development. Because of such a rocky history, and present, not many investors are interested in conducting business in Guinea. To add to this, corruption is also an ongoing problem.

The Attention of the Government

The Government just doesn’t pay much attention to gambling. They would rather work on agriculture, mining, healthcare, and education. Gambling is not an obligatory sector of economic development.

To sum up

Gambling is yet to grow in Guinea. Its history isn’t very long, but its future could be promising. Of course, other aspects of the economy first need to strengthen their core. As of now, the gambling industry is not prosperous.
