The Comptroller General of Chile has weighed in on the status of online gambling in the country, issuing an official opinion that classifies iGaming operations as illegal under current legislation. The ruling settles a complaint filed by a citizen and makes it clear that the SCJ does not have any legal powers to oversee or regulate online betting platforms that operate within Chilean territory. The decision recasts the debate on regulation and reaffirms long-standing judicial interpretations regarding unauthorized gambling.
SCJ Has No Competence to Regulate Online Betting
The Comptroller’s report makes it clear that the SCJ “lacks competence” to regulate online gambling operators. Its authority only covers land-based casinos and activities explicitly regulated by Chile’s casino laws. Because online gambling falls outside these established frameworks, the platforms remain beyond the SCJ’s jurisdiction.
That lack of authority does not relieve the regulator from responsibility, though. The ruling underlines that the SCJ is legally obliged to report illegal gambling activity and must act before the courts, either on its own initiative or upon request, to address unauthorized operations against existing law.
Online Gambling Now Officially an Illegal Activity
One of the central elements of the Comptroller’s statement is the clear categorization of iGaming as an “illicit activity” under Chilean legislation. Online betting and lottery-style games, if not formally authorized, operate in a domain outside of statutory law that controls traditional casino gaming.
This position is in line with the case law of the Chilean Supreme Court, which has constantly determined that lotteries and sports bets online shall be prohibited in general unless a specific regulation exists to support them. In previous decisions, the Court ordered several companies to abstain from the promotion and broadcast of such gambling activities and ordered the immediate blocking of websites without a license.
Judicial Reinforcement and Consumer Protection
The position of the Comptroller is in line with broader and stepped-up judicial action to rein in unauthorized gambling websites. Chilean courts have already ordered telecommunications service providers to restrict access by consumers to certain online betting websites, in light of consumer protection and compliance with the law.
The ruling also underlines some of the dangers from unregulated platforms:
- Lack of controls on player protection
- Financial integrity
- Responsible gaming.
In this case, without a regulatory structure in place, it leaves consumers at risk of fraudulent activities and denies the state an avenue to ensure integrity in gambling activities.
A Reform of Regulation Still Ongoing
While the harsh stance against online gambling remains that it is an illegal activity today, Chile is very much paving the way forward for the future regulatory model. A bill aimed at online betting regulation is in Senate debate. Proposed by the Executive Branch in March 2022, the legislation aims to introduce licensing, fiscal obligations, player protection standards, and oversight for markets.
This is a reflection of the government’s recognition that the online gambling sector is increasing, and a logical development of clear, modern rules that will protect consumers and provide a secure environment where operators can operate under regulated conditions.
A Defining Moment for Chile’s Gambling Landscape
The Comptroller’s ruling is a landmark clarification in Chile’s regulatory environment. Deeming online gambling illegal and affirming the SCJ does not have oversight powers, the ruling reinforces current legal interpretations while increasing pressure on lawmakers to advance comprehensive regulation.
The sector remains operationally active in practice, yet formally forbidden by the current law, as the Senate still debates the proposed iGaming bill.
