The Brazilian Ministry of Finance has launched a consultation process to inform the rules applicable to service providers in Brazil’s fixed odds betting industry. This was announced in a Public Consultation Notice SPA/MF No. 1/2026 published in the Federal Official Gazette of Brazil, also known as Diário Oficial da União (DOU).
The consultation is being conducted by Brazil’s Secretariat of Prizes and Betting (SPA) to determine rules for the recognition of the operational capacity of suppliers of services to licensed betting operators in Brazil. This is part of Brazil’s efforts to structure its newly regulated betting industry.
Legal Basis and Regulatory Objectives
The consultation is based on Brazil’s Ministry of Finance’s powers as outlined in Decree No. 11,907, Laws No. 13,756, and No. 14,790, which outline the legal framework for betting activities in Brazil. In addition to this, the consultation process is also based on Decree No. 12,002, which outlines the rules for consultation procedures in Brazil.
The SPA’s objective for conducting this consultation is to obtain institutional input to inform a future regulation of rules applicable to the assessment and recognition of operational capacity of suppliers of services to fixed odds betting agents in Brazil.
This is an important part of Brazil’s betting industry’s supply chain because betting agents play a critical role in the betting industry in Brazil.
Deadlines and How to Participate
The consultation phase of this public consultation in Brazil will last for 45 days from February 4, 2026, to March 23, 2026. During this time, any person or legal entity wishing to make suggestions or contributions to this consultation may do so.
Submissions can be made through the Brasil Participativo Portal, which is the official portal for the federal government’s participatory policymaking. The interested parties must adhere to the stipulated deadline to make the submission valid.
Analysis and Next Steps by the Secretariat of Prizes and Betting
Once the consultation period ends, the SPA will analyze the submissions in accordance with the procedure stipulated in Article 31, sole paragraph, of Decree No. 12,002.
The Ministry of Finance expects that the outcome of the consultation process will ensure better oversight of betting operators and their suppliers, as well as legal certainty in the national market.
The results of the technical analysis are expected to be announced at a later date after the end of the review.
Official Notice Published in the Federal Gazette
The consultation was officially announced through the following statement: “A public consultation is hereby opened to obtain contributions and information for the drafting of the Ordinance Regulating the Recognition of the Operational Capacity of Suppliers of Fixed-Odds Betting Agents in Brazil.”
Further details regarding the consultation are stated in the following paragraph: “The public consultation referred to herein shall last forty-five days, beginning on February 4, 2026, and ending on March 23, 2026.”
The document was signed by Daniele Corrêa Cardoso, Acting SPA, to emphasize the importance of the initiative.
As Brazil continues to solidify its regulation of betting, this consultation process represents an important step in establishing standards that will guide one of the most important segments of the market: service providers.
