Brazilian Labor Court Authorizes Use of Betting Platforms to Trace Debtors’ Assets

Brazil’s Regional Labor Court of the 4th Region (TRT-4) has approved a new means of recovery of assets in labor enforcement actions: consulting online betting websites to determine potential assets related to debtors.

This decision was made by the Specialized Section of Enforcement of the TRT-4 in two different labor enforcement actions in which traditional systems for searching assets were unable to locate sufficient assets to settle outstanding debts.

The decisions were made in labor enforcement actions by workers who attempted to enforce court decisions against their employers: one against a microenterprise and the other against a food processing company. In both instances, the traditional systems were unable to locate sufficient assets to settle the debt.

From Rejection to Approval on Appeal

Initially, the petitions for the issuance of official inquiries into the assets of the betting websites were rejected at the first instance. Several reasons were cited by the judges for the rejection of the petitions, among them the lack of evidence regarding the use of the websites by the debtors, the lack of direct access to the information requested, and the lack of mechanisms for the location or freezing of assets related to betting websites.

However, the decisions were appealed by the claimants through interlocutory appeals. After analyzing the appeals, the TRT-4 overturned the decisions at the first instance and approved the measure.

The court based its decision on the fact that, in those instances in which traditional systems were ineffective, other means could be necessary for the effectiveness of the decisions.

Legal Basis: Digital Wallets and Seizable Assets

This was emphasized by the reporting judge Carlos Alberto May, who underscored the fact that the Brazilian gambling regulation framework, which consists of Law No. 14,790/2023, provides for the possibility of the existence of assets deposited in the form of virtual wallets associated with the gambling platform.

Judge Maria da Graça Ribeiro Centeno reinforced this position in the parallel decision, which read in part: “In the face of the ineffectiveness of the usual enforcement methods, it is legitimate to adopt alternative means to locate the debtor’s assets, such as accessing the online betting platform.”

This decision expands the definition of financial assets subject to the enforcement process in line with the evolution of financial activities in the digital age.
