In a huge legal victory for NSX Brasil, the company that operates prominent sports betting websites Betnacional, Mr. Jack Bet, and Pagbet, the Court of Justice of the Federal District and Territories (TJDFT) has dismissed a petition of urgency that sought to close the company’s operations and impose a whopping fine of R$500 million. The action, filed as a Public Civil Action by the civil society organizations EDUCAFRO Brasil and the Center for the Defense of Human Rights “Padre Ezequiel Ramin,” alleged that NSX Brasil was negligent in sufficiently guarding children and adolescents against accessing its sites.
Civil Action Targets Child Protection Deficiencies
At the root of the lawsuit was a complaint that NSX Brasil’s betting websites were not taking sufficient measures to prevent minors from gaining access to gambling services—an assertion that the plaintiffs believed warranted the interruption of activities in Brazil and a collective moral damage indemnity of R$500 million.
The plaintiffs requested an urgent injunction to halt activities on the platforms on the basis that current measures were insufficient to comply with the nation’s child protection law. The petition was denied, however, by Judge Evandro Neiva de Amorim, of the 1st Court of Childhood and Youth of the Federal District.
Court Deems NSX Brasil’s Operations Legal
Judge Amorim, in his ruling, noted that NSX Brasil had obtained the necessary five-year license from the Brazilian Ministry of Finance to legally operate within Brazil’s emerging gambling scene. Further, the court verified that the company had already put in place biometric security measures intended to shut out minors, as per SPA Ordinance No. 1.231/2024.
The court reaffirmed the legal operation of the platforms in the current Brazilian law and denied the need for emergency intervention. Judge Amorim’s decision stated: “As the respondent has demonstrated that it has obtained the required authorization for five years, it is determined that the security mechanism—cited by the plaintiffs themselves and required by the Ministry of Finance—was correctly implemented.”
Consumer Code Not Applicable
The other major point of the decision was the court’s position on the Consumer Protection Code. The plaintiffs had tried to link NSX Brasil’s betting sites with potential violations of consumer rights, particularly for minors. However, the judge clarified that NSX Brasil’s services are legally designed for adult users, thereby excluding the basis for a consumer relationship with minors.
This legal distinction weakened the arguments of the plaintiff and further supported the decision not to impose sanctions under the Consumer Code.
Betlaw Leads Defense Strategy
NSX Brasil was advised by Bernardo Cavalcanti Freire and Leonardo Henrique Roscoe Bessa, partners of Betlaw, a law firm specializing in betting and gaming regulation in Brazil. The law firm played a key role in demonstrating regulatory compliance and the integrity of biometric systems in use.
Case Remains Open Pending Further Evidence
Although the emergency measures were denied, the case remains open. The court has permitted the plaintiffs to present more evidence that may negate the efficiency of the biometric systems. They also need to justify their request for access to NSX Brasil’s financial and user registration data—a request that was not immediately granted.
For now, the ruling provides a strong legal confirmation of NSX Brasil’s compliance with Brazil’s evolving regulatory framework for iGaming. It also underscores the importance of technical solutions—like biometric authentication—in meeting legal obligations to protect vulnerable persons, particularly children.
