The boundaries of Brazil’s state betting laws are being tested.
A recent investigation revealed that online betting sites licensed in Rio de Janeiro and Paraíba accepted wagers from players outside their authorised territories. The findings have reignited debate over how effectively Brazil can enforce its new gambling framework.
An investigation tests Brazil’s state betting laws
Six betting platforms were caught accepting out-of-state wagers.
According to G1, investigators successfully created accounts, deposited funds, and placed wagers ranging from BR2 ($0.40) to BR7 on six licensed platforms, four registered in Paraíba and two in Rio. All accepted bets from São Paulo directly contradicts Law 14.790, the legislation that underpins Brazil’s state betting laws introduced in 2023.
That law allows the Union, states, and the Federal District to operate or license fixed-odds betting and lottery services, but strictly within their own jurisdictions. In theory, a São Paulo bettor should not be able to place a wager through a Rio de Janeiro-licensed site. The investigation proved otherwise.
Experts warn of a breakdown in state boundaries
Legal researchers say ignoring borders could trigger a regulatory crisis.
Law researcher Luiz César Loques warned that violations of Brazil’s state betting laws risk creating “a competition war” between states. He said:
“If one state disregards geolocation limits, it creates a kind of competition war among states, which is not desirable.”
Constitutional law professor Telma Rocha Lisowski added that each state must enforce its own compliance measures. She argued that failure to penalise violations will only invite federal scrutiny and possible legal intervention.
Regulators promise to investigate breaches
Paraíba confirms active oversight while Rio de Janeiro remains silent.
The Paraíba Lottery Authority (Lotep) stated that it conducts “permanent oversight” and investigates any detected irregularities. Sanctions include fines and potential licence revocation.
Lotep reported BR1.7 million in revenue from betting operations in 2025, showing how profitable the market has become. But with fast growth comes increased scrutiny. The Government of Rio de Janeiro did not respond to media requests for comment, leaving observers questioning its enforcement strategy.
Five states, one shared legal challenge
The expansion of betting licences is exposing weaknesses in enforcement.
Currently, five states, Paraíba, Rio de Janeiro, Paraná, Sergipe, and Tocantins, have active betting licences. Each must follow Brazil‘s state betting laws by restricting operations to their home territories. However, digital platforms make this increasingly difficult to police.
The Ministry of Finance’s Secretary of Prizes and Betting has repeated that state betting must remain local. Repeated violations could lead to judicial action from the Office of the Attorney General, which has the power to enforce national compliance.
Technology outpaces regulation
Digital access is challenging Brazil’s ability to uphold its own laws.
The cross-border betting scandal shows how quickly online innovation can outpace legal systems. With VPNs and digital wallets making it easy to hide user locations, enforcing Brazil’s betting laws has become a complex technical battle rather than a simple jurisdictional one.
If regulators fail to adapt, states could begin competing for bettors nationwide, turning a controlled market into open chaos. For a country still shaping its gambling landscape, the stakes could not be higher.
As Brazil’s betting industry grows and oversight struggles to keep up, one question remains: can the country modernise its state betting laws fast enough to protect its own market?
