Two deputies from Argentina, Guillermo Michel and Marianela Marclay, both from the province of Entre Ríos, have put forth a bill to ban those who are registered as defaulters in child support payments from entering any casino or participating in any form of online gambling.
The bill is aimed at strengthening the enforcement of child support payments and adhering to parental responsibilities. The core idea behind this bill is the establishment of a Federal Registry of Child Support Defaulters (REFIOA), which would operate at the national level.
Michel, in this context, stated: “With the creation of a Federal Registry, we can overcome this limitation, providing national validity to judicial decisions and strengthening interjurisdictional coordination.”
Scope of the Proposed Restrictions
The bill has been designed in such a manner that any individual who is registered in the REFIOA would not be allowed to access any of the following places:
Casinos
Bingo halls
Betting agencies
Online gambling platforms authorized by state authorities
Although some provinces in Argentina, such as Buenos Aires and Salta, have already put in place such restrictions, this bill by Michel and Marclay is aimed at implementing this at the federal level, thus removing any scope for discrepancies in the rules and regulations in different provinces.
Marclay, in this context, mentioned: “The law has two objectives: to give real validity to already established rights, such as the payment of child support, and to provide a concrete solution to a social problem that affects a significant number of families in the country.”
The proposal is in line with a wider legislative trend that seeks to link access to certain recreational activities with compliance with family obligations.
Provincial Precedent in Salta
A similar policy was approved in the province of Salta in August 2025, when the Senate there approved on final reading a law prohibiting those whose names appear in the Registry of Child Support Debtors from entering casinos and gaming houses.
One of the proponents of the policy in Salta, Senator Javier Mónico, justified the policy when he stated: “It is a sanction so that those who do not comply with child support obligations face concrete consequences. It is not essential, and entering a gaming house can even be an aggravating condition for someone who has child support obligations.”
He further stated: “Mothers, generally, and minor children suffer when a person does not comply with child support. It is frustrating to know that the judicial system does not assist us, that it is very bureaucratic, and these people end up evading their child support obligations. As a society, we have the obligation to create mechanisms that oblige those who have child support obligations to comply, beyond judicial means.”
A Broader Policy Debate
This federal proposal has raised several policy debates regarding the balancing act between the rights of individuals and the need to ensure that those who are vulnerable are protected. However, there are concerns regarding the proportionality of the policy, which might be raised in the future.
If approved, the establishment of REFIOA will be a major step in the regulation of child support in Argentina, as it will integrate the issue of financial compliance into the overall framework of laws regulating the entry of people into casinos and gaming houses.
